These Terms and Conditions (“Terms”) govern your use of our website, mobile application, and any other services provided by Etree Private Limited (“Etree.pk”, “we”, “us”, or “our”). By accessing or using our website, placing an order, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.

Binding Agreement: By using our site and services, you represent that you have read, understood, and agree to be bound by these Terms and all policies referenced herein, including our Privacy Policy, Return and Cancellation Policy, and Product Guarantee.
Eligibility: You must be at least 18 years old or have the legal capacity to enter into a binding contract in your jurisdiction to use our website and services.

Updates: Etree.pk reserves the right to update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the website. Your continued use of the site after such modifications constitutes your acceptance of the new Terms.

3. Use of Our Website and Services

Access: We grant you a limited, non-exclusive, and revocable license to access and use our website and services for personal, non-commercial purposes only.
Prohibited Activities: You agree not to engage in any activity that interferes with or disrupts the operation of our website, services, or servers, including (but not limited to) unauthorized data mining, redistribution of content without permission, or any form of fraud.

Accuracy: When you register an account or place an order, you agree to provide accurate, current, and complete information and to update it as necessary.
Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use.

5. Ordering and Payment

Placing Orders: All orders placed through our website are subject to acceptance by Etree.pk. We reserve the right to refuse or cancel any order at our discretion.
Pricing: Prices displayed on our website are in Pakistani Rupees (PKR) and are subject to change without notice. The total price charged includes applicable taxes and shipping charges unless otherwise stated.
Payment: Payment must be made through the designated secure payment methods. We do not store or process credit card information on our servers; all payment transactions are handled by trusted third-party gateways.

6. Product Guarantee & Substitution Policy

Quality Guarantee: We guarantee that every plant is of the highest quality and will be handled with care. Please review our Product Guarantee policy for details regarding damaged-in-transit claims and healthy plant warranties.
Substitution: If the plant you ordered is not available in stock, a substitute plant from a similar category of equal or greater value will be shipped at no extra cost to you. This substitution is subject to our discretion based on availability and comparable quality.

7. Shipping and Delivery

Shipping Process: Orders are processed and shipped in accordance with our Shipping Policy. We will use reputable carriers to ensure that products are delivered in a timely manner.
Delays and Damages: While we take every precaution to ensure prompt delivery, Etree.pk is not responsible for shipping delays or damages occurring after the products leave our facility. For issues related to transit damage, please refer to our Product Guarantee for the claims process.

8. Cancellations, Returns, and Refunds

Cancellation Policy: Orders may be canceled prior to dispatch as specified in our Return and Cancellation Policy. Once an order is confirmed and processed, cancellation may be subject to our standard procedures.
Returns and Refunds: We do not issue cash refunds. All approved returns will be processed as store credit (with applicable adjustments, such as a 5% bonus) as detailed in our Return Policy.
Conditions: Requests for returns must comply with our established terms, including notification timeframes, product condition requirements, and retention of original packaging where required.

9. Intellectual Property

Ownership: All content on Etree.pk—including text, graphics, logos, images, audio clips, and software—is the property of Etree Private Limited or its licensors and is protected by applicable intellectual property laws.
License: You may view, download for caching purposes only, and print pages for personal use, provided that you do not modify them or use them for commercial purposes without our express written consent.
Prohibitions: Any unauthorized reproduction, distribution, or otherwise exploitation of our content is strictly prohibited.

10. Limitation of Liability

Disclaimer: Except as expressly provided in our Product Guarantee, Etree.pk makes no warranties, express or implied, regarding the fitness, quality, or merchantability of our products or services. Our remedies for any issues are limited to those specified in our policies.
Extent of Liability: Etree.pk shall not be liable for any damages, losses, or expenses exceeding the original purchase price of the product, including, without limitation, any indirect, incidental, or consequential damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless Etree.pk, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of our website, your violation of these Terms, or your infringement of any rights of a third party.

12. Governing Law and Dispute Resolution

Applicable Law: These Terms and your use of our website shall be governed by and construed in accordance with the laws of Pakistan.
Jurisdiction: Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Pakistan.
Dispute Resolution: We encourage amicable resolution of disputes. If a dispute arises, please contact us to attempt to resolve the issue before seeking legal recourse.

13. Force Majeure

Etree.pk shall not be liable for any delays or failures to perform its obligations under these Terms if such delay or failure is due to circumstances beyond our reasonable control, including, but not limited to, acts of God, natural disasters, war, or government restrictions.

14. General Provisions

Entire Agreement: These Terms, along with our Privacy Policy, Return & Cancellation Policy, and Product Guarantee, constitute the entire agreement between you and Etree.pk concerning your use of our website and services.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and Etree.pk’s failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
